California Pregnancy Leave Law



Someone just asked a question about which benefits are subject to the benefits continuation provision under the new California Pregnancy Leave law (S.B. 299). Does it apply to just medical benefits? Or does it apply to dental and vision as well? The law defines eligible benefits as benefits under a "group health plan, as defined in Section 5000 (b)(1) of the IRS code." This same code section defines benefits subject to COBRA, thus, any COBRA-eligible benefits would also be subject to SB 299 continuation. That means that medical, dental, vision, FSA, and some EAP plans would all be subject to continuation under the California Pregnancy Leave law.
